Welcome to Luma ("we," "our," or "us"). By downloading, installing, or using our mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). Please read them carefully.

1. Acceptance of Terms

By accessing or using Luma, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our App.

2. Eligibility

You must be at least 13 years old to use this App. By using Luma, you represent and warrant that you meet this age requirement. If you are under 18, you must have permission from a parent or guardian to use the App.

3. License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use Luma for personal, non-commercial purposes, subject to these Terms.

Create derivative works based on the App

4. User Content and Conduct

You are responsible for your use of the App and any data you provide. You agree to use the App in compliance with all applicable laws and regulations.

5. Intellectual Property

All content, features, and functionality of Luma, including but not limited to text, graphics, logos, icons, images, and affirmation content, are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws.

Important: The affirmations, design elements, and all content within Luma are our intellectual property. Unauthorized use, reproduction, or distribution is prohibited.

6. Subscriptions and Payments

Luma may offer free and paid features. If you purchase a subscription:

Subscriptions are managed through your Apple ID or App Store account
Payment will be charged to your account at confirmation of purchase
Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
You can manage subscriptions in your App Store account settings
No refunds for the current subscription period

7. Free Trial

If we offer a free trial, you will be charged when the trial period ends unless you cancel before the trial ends. You can cancel anytime through your App Store account settings.

8. Disclaimer of Warranties

Non-infringement
Accuracy, reliability, or availability

9. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

Your use or inability to use the App
Any unauthorized access to or use of our servers
Any bugs, viruses, or other harmful code
Any content or conduct of any third party

10. Indemnification

You agree to indemnify, defend, and hold harmless Luma and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your use of the App or violation of these Terms.

11. Changes to the App

We reserve the right to modify, suspend, or discontinue any aspect of the App at any time without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the App.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the App after changes constitutes acceptance of the new Terms.

13. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of your jurisdiction, without regard to its conflict of law provisions.

15. Dispute Resolution

Any disputes arising out of or relating to these Terms or the App shall be resolved through binding arbitration, except that either party may seek injunctive relief in court.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Luma regarding the use of the App.

19. App Store Terms

By downloading Luma from the Apple App Store, you agree to Apple's standard End User License Agreement (EULA). In case of conflict between these Terms and Apple's EULA, these Terms shall prevail regarding your use of the App.

20. Acknowledgment

By using Luma, you acknowledge that you have read these Terms of Use and agree to be bound by them.
